THE LAND ACT, NO. 4 OF 1999 IS THE LAW THAT GOVERNS GENERAL LAND MATTERS IN TANZANIA. ALL LAND IN TANZANIA IS VESTED WITH THE PRESIDENT AS TRUSTEE FOR AND ON BEHALF OF ALL THE CITIZENS OF TANZANIA.
Ownership of land in Tanzania is framed in a tenure system referred to as a Right of Occupancy which is a registered Certificate of Title (Title Deed). A Right of Occupancy is granted for up to 99 year intervals. Upon expiration of the granted term, the Right of Occupancy is automatically renewed for the same initial term as provided under section 32 (3) of the Land Act, so long as all the conditions relating to the Right of Occupancy were adhered to, namely observation of the land use conditions and payment of the annual nominal land rent due to the Government.
With regard to the Manyatta project the said Right of Occupancy was issued for 99 years starting on the 1st July 1963, currently the Right of Occupancy has a remaining tenure of 45 years left to run before automatic renewal to the original 99 year term. Manyatta Tanzania has acquired residential use rights over the said land and has sub-divided the area into 2 acre low density plots.
With the above structure in place Manyatta can transfer rights of occupancy to prospective purchasers and/or offer long term registered leases to a company or person, both Tanzanian and Non Tanzanian for the remainder of the 45 year term and the subsequent renewal of a 99 year term. These long term leases are as good as the original right of occupancy and may be sublet and used as a form of security.
Any interested buyer simply chooses the plot(s) of his/her choice, followed by execution of the necessary documentation and completes payment on the agreed purchase price. The long term lease shall then be registered with the Registrar of Titles, and the purchaser of a plot shall be free to transfer, sub-lease and mortgage the said property. Any future sale by a purchaser shall entail that the same conditions and restrictions provided by Manyatta.
